This Service Agreement (hereinafter referred to as "Agreement") is a legal document established between Kaze AI (hereinafter referred to as "We" or "Service Provider") and the user regarding access to, registration for, login to, and use of the AI Image Generation and Processing Product (hereinafter referred to as "This Product" or "Service"). This Agreement clarifies the rights, obligations, and responsibilities of both parties. By accessing and using Kaze AI, you agree to be bound by the Agreement. Please read them carefully before proceeding.

1. Description of Services

Kaze AI is an innovative and user-friendly AI-powered image processing platform that offers a comprehensive suite of services designed to enhance, transform, and personalize your images with ease. Our state-of-the-art algorithms leverage the power of artificial intelligence to deliver high-quality results tailored to your specific needs. By utilizing Kaze AI, you gain access to a powerful toolset that empowers you to take your image processing to the next level.

2. Registration and Access

To fully access and utilize the advanced image processing services offered by Kaze AI, users are required to complete a simple registration process. During the registration process, you must provide accurate and complete information, and you are responsible for maintaining the confidentiality of your account credentials. We reserve the right to suspend or terminate any account for any reason, including but not limited to violation of these Terms of Use or our Privacy Policy.

You have the option to use our third-party platform account authorization login feature. This allows you to register and log in to Kaze AI using a user account that you legally own from a third-party software or platform. By choosing to use this feature, you authorize Kaze AI to access and use your third-party account information for the sole purpose of verifying your identity and enabling you to use our services. We will only request the minimum permissions necessary to facilitate this process.

You must be at least 13 years old or the minimum age required in your country to consent to the use of our services. This age requirement is in line with international standards and is designed to protect the privacy and well-being of younger users. If you are under the age of 18, you must obtain the permission of your parent or legal guardian before using our services. This policy is in place to ensure that minors are using our services with the appropriate guidance and supervision. While we do not actively verify the age of every user, we encourage users to comply with these age requirements and parental consent policies. In the event that we become aware of any users who do not meet these requirements, we reserve the right to suspend or terminate their access to our services.

3. Restrictions of Services

You agree not to engage in any of the following prohibited activities while using Kaze AI:

Using the services for any illegal purpose or in violation of any local, state, national, or international law.
Uploading, posting, or transmitting any content that infringes on the intellectual property rights, privacy rights, or other rights of any third party.
Introducing any viruses, malware, or harmful code that could damage or interfere with the operation of Kaze AI or any related systems.
Attempting to gain unauthorized access to any part of the services, other accounts, or any computer systems or networks connected to Kaze AI.
Using the services for commercial purposes, including advertising or selling products or services without our express written consent.
Engaging in any form of harassment, abuse, or threatening behavior towards other users or third parties.
Collecting or harvesting any personally identifiable information from Kaze AI without consent.

4. Content and Intellectual Property Rights

Content Ownership: Kaze AI retains all ownership and intellectual property rights in the AI image agent services, including any software, algorithms, and AI models used to provide those services. However, you retain ownership of any content you upload or create using the AI image agent, subject to the rights granted to Kaze AI as described below.
User Content Rights: By uploading or creating content using the AI image agent, you grant Kaze AI a non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the content in connection with the services. This license allows us to operate and improve the AI image agent services.
Copyright Protection: You are solely responsible for the content you upload or create using the AI image agent. You must ensure that you have the necessary rights to any content you provide to the AI image agent, including any necessary licenses or permissions. Kaze AI is not responsible for any copyright infringement resulting from your use of the AI image agent.
Restrictions on Use: You may not use the AI image agent to create or distribute content that infringes on the intellectual property rights of others, including copyright, trademark, or patent rights. You also may not use the AI image agent to create or distribute content that is defamatory, obscene, or otherwise illegal.
Data Privacy and Protection: Kaze AI is committed to protecting your privacy. We will only use your content and any data generated by the AI image agent in accordance with our Privacy Policy and as permitted by applicable law. You agree that we may collect, use, and disclose your content and any data generated by the AI image agent for the purposes of providing the services and as otherwise described in our Privacy Policy.
Reporting Inappropriate Content: If you become aware of any content generated by the AI image agent that violates these restrictions, you should report it to Kaze AI immediately. We reserve the right to remove any content that violates our terms of service or applicable laws.
Compliance with Law: You agree to use the AI image agent in compliance with all applicable laws and regulations, including copyright, trademark, and other intellectual property laws. You also agree to respect the rights of others and not to use the AI image agent in any way that infringes on the rights of third parties.
Intellectual Property Notices: Kaze AI respects the intellectual property rights of others and expects users of the AI image agent to do the same. We will respond to notices of alleged copyright infringement that comply with applicable law and are properly provided to us.

5. Payment Terms

In order to ensure a smooth and transparent payment process, we have outlined our Payment Terms below. Please review them carefully before proceeding with any paid services.

Paid Services: Certain services of Kaze AI may be subject to payments now or in the future (the “Paid Services”). Paid services may include advanced image editing features, high-resolution output, expedited processing, or access to premium content and templates. Please see our Paid Services page for a description of the current Paid Services. By choosing to make a payment for any feature or service on Kaze AI, you agree to pay the specified amount using your selected payment method. This transaction is subject to the acceptance of our Terms of Use and any additional terms related to the specific feature or service.
Billing: If you purchase any Services, you will provide complete and accurate billing information, including a valid payment method. We use a third-party payment processor (the “Payment Processor”) to bill you through a payment account linked to your account on the Services (your “Billing Account”) for use of the Paid Services. The processing of payments will be subject to the terms, conditions, and privacy policies of the Payment Processor in addition to these Terms.
Payment Method: We accept a variety of payment methods. Please note that not all payment methods may be available in all regions.
Recurring Billing: For certain paid services, we offer recurring billing options, such as monthly or annual subscriptions. Unless you opt out, your subscription will automatically renew at the end of each billing cycle. We will send you a reminder email prior to the renewal date, detailing the upcoming charge and the amount due. You can cancel your subscription at any time by logging into your account and following the cancellation instructions, or by contacting our customer support team. Cancellation must be completed before the renewal date to avoid being charged for the next billing cycle.
Changes: We reserve the right to adjust our pricing structure at any time. Any price changes will be communicated to you via email or through our website, and will take effect on your next billing cycle. If you need to update your payment method, you can do so by logging into your account and navigating to the payment settings section.
Late Payments and Non-Payment: In the event of late payment, we may apply a late fee as specified in your invoice. If payment is not received within a reasonable timeframe, we reserve the right to suspend or terminate your access to paid services until payment is received.
Refunds: Our refund policy varies depending on the type of service purchased. For subscription services, refunds are generally not provided for unused portions of the billing cycle. For one-time purchases, refunds may be considered on a case-by-case basis. To request a refund, please contact our customer support team within the specified timeframe outlined in our refund policy.
Fraud Prevention: We may implement measures to detect and prevent fraudulent transactions. If we suspect that a transaction is fraudulent, we reserve the right to cancel the transaction and suspend your account pending further investigation.

6. Termination and Suspension

Termination by You: You may terminate your account at any time by contacting us. Upon termination, your access to Kaze AI will cease, but any obligations incurred prior to termination will remain in effect.
Termination by Us: We reserve the right to suspend or terminate your access to Kaze AI at our discretion, without notice, if we believe you have violated these Terms of Use or engaged in conduct that may harm Kaze AI or other users. Upon termination of your account, all licenses granted to you under these Terms will immediately cease, and you will no longer have access to any User Content or other data associated with your account. We may retain certain information as required by law or for legitimate business purposes. We may temporarily suspend access to Kaze AI for maintenance, repairs, or upgrades. We will make reasonable efforts to notify you of such suspensions in advance. Kaze AI will not be liable for any damages or losses resulting from the termination or suspension of your access to the services.

8. Warranty Disclaimer

In no event shall Kaze AI, its affiliates, directors, employees, or agents be liable for any direct, indirect, incidental, special, punitive, or consequential damages, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses (even if we have been advised of the possibility of such damages). This limitation applies to all matters relating to the services, including but not limited to the use of the services and any related content. Kaze AI shall not be liable for any damage or loss caused as a result of your reliance on the services or any content generated by the AI image agent. We are not responsible for any third-party content that you access with the services, and you agree that your use of such content is at your own risk.

9. Limitation of Liability

Kaze AI provides the AI image agent services on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We make no warranty that the services will meet your requirements, be uninterrupted, secure, or error-free. We will not be liable for any delay or failure to perform our obligations under these terms if such delay or failure is caused by events beyond our reasonable control, including but not limited to acts of God, strikes, lockouts, riots, civil commotion, fire, flood, or restraints by government or public authorities. Kaze AI may include or provide links to third-party services that are not under our control. We are not responsible for the content, accuracy, or reliability of any third-party services or websites linked to from our services. Access to and use of third-party services are at your own risk. You agree to use the services in compliance with all applicable laws and regulations. Kaze AI shall not be responsible for any violations of law caused by your use of the services. You understand that all content submitted, posted, or otherwise transmitted via the services is your sole responsibility. Kaze AI does not guarantee the accuracy, completeness, or usefulness of any content, and is not responsible for any loss or damage resulting from your reliance on content.

10. Modifications to Terms

We reserve the right to modify these Terms of Use at any time, in our sole discretion. If we make any changes to these Terms, we will notify you in one or more of the following ways:

By sending you an email or other communication that directly notifies you of the changes.

It is your responsibility to review these Terms periodically for any changes. Your continued use of the Site and our services (the "Services") after we have notified you of modifications to the Terms constitutes your acceptance of the modified Terms and your agreement to be bound by them. Furthermore, by continuing to use the Site and Services, you are also indicating your agreement to license our products (the "Products") as further detailed in our Agreement or other relevant agreements. Please ensure that you have read and understood all applicable agreements before using our Products.

Additional Terms Specific to Watermark Removal

A. User Content Ownership & Rights Declaration

By uploading or submitting any content, you represent that you own all necessary rights or have obtained permissions to use and modify the content through Kaze AI.

B. Prohibited Content Clause

You may not use Kaze AI to remove watermarks from content you do not own or lack legal rights to modify. This includes copyrighted works from professional photographers, studios, or stock libraries.

C. Liability Disclaimer for Watermark Removal

We do not monitor user uploads. You are solely responsible for ensuring legal compliance. We disclaim all liability for any legal disputes arising from user-submitted content.

D. Indemnification

You agree to indemnify and hold harmless Kaze AI and its affiliates against any claims or damages arising from your violation of these Terms or infringement of third-party rights.

E. User Agreement Confirmation

Before using the service, you must confirm the following: "By uploading images or URLs, you agree to our Terms of Service. To learn more about how kaze.ai processes your personal data, please review our Privacy Policy."
